starter keeps disengaging, unless no spark

weird issue with my 96 gsx

just rebuilt

i was able to get it started, but on the water when i rev it up it does not accelerate, just boggy i think would be the right word. it does not go past maybe 5-10 km/h
when i let of the throttle after revving it up it instantly dies and has 12v low and does not start for a while

i think okay maybe a charging issue, i am looking into this more

but then when i try to start it, it also is weird because the starter engages for a couple seconds, then disengages and i can hear the starter spinning but it is not engaged with the engine, so i have to stop, wait for it to stop spinnning and try again.

then i noticed that when the battery voltage dipped low, and it was no longer sparking, the starter was staying engaged for as long as i held the start button. but it wouldnt start now cause there is no spark....thoughts?
 
First thing, fully charged load tested battery.
ignition will lose spark with low battery voltage.
