Drinking on Boat

You need to look up the local laws. It is different everywhere.

Here in Texas, you can all drink, including driver while driving. They only harrass you if you act like a fool, then they can get you for DUI. But if you are taking it easy and enjoying a cold one on a hot day, the law says that is fine.

You should be able to find your laws through your fish and game department.

Better check your local laws,in Mississippi passengers can but the operator can't.

Here is what I found on the internet in Virginia's boating laws.

http://www.dgif.virginia.gov/boating/wog/

A person(s) being towed on water skis or other device may not operate while under the influence of alcohol or drugs, including prescription narcotics and illegal drugs.

At boat ramps "public display of alcohol is prohibited."

Virginia’s law states that boat operators with blood alcohol concentrations of.08 percent or more by weight, by volume, shall be presumed to be under the influenceof alcoholic intoxicants.

That is all I could find. It doesn't clearly state that you can or cannot hold a beer and drink it while driving, so you better ask around. You could even approach a cop on the water and ask (while NOT holding a beer, I would suggest :reddevil:)

if you are smart you'll put it in a cup or a koozie, and keep it out of sight when the local law is around...

I think you are wrong. The law is the same for boats as is cars in TX. the only difference is that open containers are allowed except for driver while underway.

Does the "Open Container" law apply when I'm in my boat?

No. This law, effective 9/1/2001, prohibits the possession of an open container of an alcoholic beverage in the passenger area of a motor vehicle. It does not apply to watercraft.

Game Wardens enforce the Boating While Intoxicated (BWI) law. A person who either appears to be impaired and/or has a blood alcohol level of 0.08 or higher while operating a boat can be arrested for BWI.

From Texas Parks and Wildlife website.

I was unsure about driving while drinking and called them, and they said "do it moderately, and don't act stupid or they will have an excuse to board your boat and do a breathalyzer."

And of course, the BEST argument when/if I get pulled over is "But Officer, EVERYBODY DOES IT!!!" :reddevil:

In Washington no one on the boat can drink. You have to be standing on the shore in order to drink. If you get caught its a DUI, huge ticket, and they impound your boat.

I always thought being on the water and drinking went hand in hand. As with all things in life: everything in moderation.

That said, I hate seeing fools that put others in danger to have a good time. I'm not sure how many people could ride a seadoo and drink anyway...
