5 people in a 4 seater?

I think I already know the answer to this, but, can 5 people sit in a 4 seater sportster? meaning one child on an adults lap? would you get a ticket? Im guessing probably, so...are there any 5 seater 4 strokes out there? seems like a 7 seater would be the smallest 4 stroke for a family of 5. thanks!

It probably depends on your jurisdiction, in the US there is a plaque which clearly states capacity of boats. Number of persons, and weight allowed, I don't think the water cops at our lake are too concerned unless the see a boat riding in the water lower than they think it should be.
