2009 Challenger 180 see air filter/silencer question

Hello all, I recently purchased a 2009 Challenger 180, and noticed it has an aftermarket cone air filter on it that's very dirty and needs to be replaced. I saw the factory one for $105.00. Is this necessary, or will a new aftermarket cone that fits work fine? I noticed by doing research that the OEM one also is titled as a silencer too. Any insight would greatly appreciated
 
I had my cone air filter replaced at Jet Trendz in New Port Richey, FL a few years back. I was having a oil sensor replaced when Bret found out that who ever replaced the air filter previously, installed one with a metal screen and it was rusting. Rust particles were entering the engine from this air filter. Luckily this was caught in time and no permanent damage occurred. I think it was a extra $50.00. So be careful what air filter you buy and install. Make sure it has no metal parts or screens.
